What’s covered in these terms?

We know it’s tempting to skip these Terms and Conditions, but it’s important to establish what you can expect from us as you buy BALKONISTA products and services, and what we expect from you.
These Terms of Service reflect the way BALKONISTA's business works, the laws that apply to our company, and certain things we’ve always believed to be true. As a result, these Terms and Conditions help define BALKONISTA’s relationship with you as you interact with our services.

Below you will find the rules for using the Balkonista online store available at https://balkonista.pl/, hereinafter referred to as the Store.

The website located at this address belongs to Balkonista OÜ, and this document is hereinafter referred to as the Regulations. If we write in the form "we" (Ours, our), we mean Balkonista. This also applies to sentences when we use words such as "we pay", "we send", "we implement". When we use the form "You" (E.g., You, Yours, etc.), we refer to the Client. This also applies to sentences when we use words such as "you commit", "you can", "you inform".

General terms and condition of use

Our Regulations are the regulations referred to in art. 8 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws 2020, item 344, consolidated text). They define the rules of using the Store, in particular:

  • rules for using the Balkonista store,
  • terms and conditions for placing orders for products available in the Balkonista store,
  • terms and conditions for delivering ordered products to Customers, 
  • terms and conditions of payment,
  • the Customer's rights to cancel the order and withdraw from the contract,
  • principles of submitting and considering complaints,

as well as your and our other rights and obligations.

Rules for using the BALKONISTA store

To use the Store, you need: a) computer/tablet/phone with Internet access, b) an internet browser such as Internet Explorer version 8 or newer, Google Chrome, Mozilla Firefox, Opera, Safari with JavaScript support enabled, c) active electronic mail (e-mail) account.

To make a purchase in our Store, you must first read and accept the Regulations.

Balkonista OÜ operates the Balkonista store with its registered office in Harju maakond, Tallinn, Järvevana tee 9, 11314, Estonia. Registration # 17240122.

You are prohibited from providing us with illegal content and from using the Store in a way that disrupts its operation or is burdensome to us or other Customers.

You can access the Store Regulations at any time via the link provided on the Store website at https://plantsforhumans.com/pages/regulamin and download, save and print them.

Information about the products provided on the Store website constitutes an offer within the meaning of Article 66 of the Civil Code. This means that sending an Order by you constitutes a declaration of intent to conclude a sales agreement with us for the products you have selected. The agreement is concluded upon confirmation of receipt of the Order by us. After concluding the agreement, you will receive an e-mail containing confirmation of all essential elements of the Order, including information about the products purchased, price and delivery date.

The products we offer in the Store may differ slightly from those shown in the photos on the website, especially in the case of potted plants. We make every effort to display the colours and photos of our products as accurately as possible. Unfortunately, we cannot guarantee that your computer's display will accurately reflect the colours of the products we offer. 

Selecting certain options on the Store website may direct you to external websites, such as those of payment operators. The Regulations apply only to the Store website and do not apply to other websites.

Placing an order and conclusion of a contract

To place an Order, you must visit the website www.balkonista.pl, select the goods, and follow the subsequent steps based on the messages displayed to you and the information available on the Store website. 

You select the products you wish to purchase by adding them to your shopping cart.

During the Order placement process – until you click the “Pay now ” or “ PayPal”, “Shop Pay”, “G Pay” or other similar button – you can change the selected products, their quantity, or modify the entered data. To do this, follow the displayed messages and information available on the Site.

After selecting " Next" on the shopping cart page, you will be asked to:

  • complete the Order form with the necessary data, in particular your contact details;
  • select the payment option;
  • check the summary of the Order, including the total price and detailed information about the selected products, after entering all the necessary data;  
  • accept and send the Order by clicking the " Pay now " button.

When placing an Order, you can opt to allow us to remember your data for future orders. This will enable us to expedite the process of filling out the Order form in the future. 

By placing an Order, you are making us an offer to conclude a sales contract for the products you have selected, under the terms and conditions specified in the Order. 

The sales contract between us is concluded upon our confirmation of receipt and acceptance of the Order. 

The recording, securing, and sharing of the content of the concluded sales agreement occur via the Store's sales system and are sent to the email address you provided when placing the Order. As a result, you will be provided with a digital document confirming the conclusion of the agreement along with its content.

If you are not a consumer, we shall only be liable within the scope of contracts concluded by us in the event of intentional damage to you and within the limits of the losses actually incurred by you.

Payment and delivery

We offer several secure payment options for your convenience: 

  • Card payments: Visa, MasterCard and American Express are accepted via our secure payment gateway;
  • Accelerated checkout methods: Apple Pay, Google Pay, Shop Pay, and PayPal. These methods allow you to complete the purchase quickly using saved credentials;
  • Local payment methods: Blik, PayU are available through our integrated providers.

We offer delivery in Warsaw and its suburbs performed by the Balkonista team.

We offer product deliveries in Warsaw and its suburbs only.

The time limit for completing the Order is from 48 to 72 hours counted from the date of placing the Order. Deliveries of floral compositions are made from Monday to Saturday. 

If the product is delivered with apparent damage, incurred during delivery, we kindly ask you to report this fact to us immediately by email at info@balkonista.pl  

The final amount to be paid by you consists of the product price and the shipping cost. The shipping and payment costs are always visible to you in the Order form, at the stage of placing the Order and in the Order summary. 

The prices we quote in Polish zloty are gross prices (including VAT).

If you are an entrepreneur and have entered the appropriate data in the Order form, we will issue you a VAT invoice at your request. If you are a Consumer, the sale is documented using receipts. We deliver invoices and receipts in electronic form, sent to the email address provided when placing the Order.

Withdrawal from the contract

In accordance with Article 38, point 4 of the Act of 30 May 2014 on consumer rights, we inform you that you have no right to withdraw from the contract of sale of plants due to the fact that these are goods that spoil quickly and have a short shelf life.

You have the right to withdraw from the sales contract without giving any reason within fourteen (14) calendar days in the case of products other than plants. The provisions of this section apply only to Consumers. 

The 14-day period for withdrawal from the sales contract begins on the day the Order is received by you or another household member at the address indicated in the Order. 

To exercise your right to withdraw, you must submit a declaration of withdrawal from the sales contract to us. The declaration may (but does not have to) be submitted using the form, which constitutes Annexe 1 to the Regulations.

You can submit a declaration of withdrawal from the sales contract to us:

  • by sending them by post or courier together with the product to our address; 
  • to the email address: info@balkonista.pl

If the declaration of withdrawal is submitted by e-mail, we will immediately confirm receipt of the information about the withdrawal by means of a return e-mail sent to your address provided in the declaration.

To meet the 14-day deadline for exercising the right of withdrawal, it is sufficient to send us your declaration before the deadline expires via any of the methods indicated above.

The consequence of your exercising your right of withdrawal is that the sales contract is deemed not to have been concluded. 

If you decide to withdraw from the sales contract:

  • we will refund to you immediately, i.e. no later than within fourteen (14) days from the date of receipt of the declaration of withdrawal, all payments made by you, including the costs of our delivery of the products;
  • we will refund the payment to the bank account provided on the return form;
  • you will be obliged to return the products to us immediately, no later than fourteen (14) days from the day on which you informed us of your withdrawal from the sales contract, by sending them to our address. The return deadline is met if you send us the product before the expiry of the fourteen (14) day period;
  • the costs of returning the products in connection with the withdrawal from the sales contract will have to be borne by you;
  • we may withhold reimbursement until we receive the products back from you or until you provide evidence of having sent them back, depending on which event occurs first;
  • please note that if the products reach us damaged or destroyed, we may refund you a portion of the funds corresponding to the value of the damage or refuse to refund at all in the event of damage.

Personal data protection

The principles governing the processing of your personal data are outlined in the Privacy Policy

The Privacy Policy constitutes an integral part of these Regulations.

Complaints

You always have the right to file a complaint about our products or the operation of the Store: 

  •  in writing to our address; 
  • to the e-mail address: info@balkonista.pl.

Your complaint should include: 

  • information about the product or the functioning of the Store, in particular the type and date of the defect or a description of the situation; 
  • specification of the request regarding the method of removing the defect or resolving the situation; 
  • your contact details. 

If you decide to exercise your warranty rights, if we deem it necessary to consider the complaint, you will be obliged to deliver the defective product to us at our expense, to our address.

We undertake to take appropriate measures to ensure the proper operation of the Store and to remove any reported technical faults within a reasonable time.

We undertake to respond to your complaint promptly, within fourteen (14) days from the date of its submission.

Despute resolution

We inform you that there are possibilities for using out-of-court methods to handle complaints and pursue claims. Using them is voluntary and can only take place when We and You agree to it. 

As a Consumer, you may submit a request to initiate proceedings for the out-of-court resolution of consumer disputes concerning the concluded sales contract to the Trade Inspection, in accordance with Article 36 of the Act of 15 December 2000 on the Trade Inspection.

As a Consumer, you may also file a request for the resolution of a dispute concerning the concluded Sales Agreement by a permanent arbitration court operating at the Voivodeship Inspectorate of Trade Inspection, in accordance with Article 37 of the Act of 15 December 2000 on Trade Inspection.

Detailed information on the method of resolving disputes, including the possibility for you, as a Consumer, to use out-of-court methods of complaint resolution, pursuing claims and the rules of access to these procedures are available at the offices and on the websites of the Voivodeship Inspectorates of the Trade Inspection and at the following internet address: https://uokik.gov.pl/spory_konsumenckie.php

Changes to the regulations

We may change the Regulations in the event of changes in legal provisions which require an update of the Regulations.

These Regulations are effective from 14/05/2025

Final provisions

The regulations are subject to Polish law.

If you are a Consumer, any disputes arising from the application, performance or interpretation of the Regulations shall be resolved by the competent common courts of the Republic of Poland.

If you are not a Consumer, any disputes arising from the application, performance or interpretation of the Regulations shall be resolved by a common court having jurisdiction over our registered office.
